GENERAL TERMS AND CONDITIONS OF SALE – COLIBRI RIDERS

ARTICLE 1 – IDENTITY AND PURPOSE

These GTC govern sales between Colibri Riders (SASU, RCS Paris 939 572 830) and any adult individual making a purchase on the site. Any order implies full and complete adherence to these conditions.

ARTICLE 2 – MADE-TO-ORDER MANUFACTURING MODEL

Colibri Riders operates on a sustainable production model: each item is manufactured specifically after order validation.

  • Advantage: This model avoids textile waste and guarantees a new, never-stocked product.
  • Constraint: This implies longer processing times than in traditional retail.

ARTICLE 3 – PRODUCTS: COLORS AND MEASUREMENTS

3.1 Visuals: We take the utmost care in the accuracy of photos. However, color rendering may vary depending on the screens. These variations cannot constitute a defect of conformity.

3.2 Measurements: Size guides are provided for information purposes only. A variation of +/- 2 cm from the measurement charts is tolerated by textile industry practices and cannot lead to a free return.

ARTICLE 4 – PRICE AND PAYMENT

Prices are in Euros including VAT. Delivery costs are indicated before final validation. Payment is due immediately by Credit Card, PayPal, or any other secure method offered on the site.

ARTICLE 5 – DELIVERY

5.1 Times: The average delivery time is 7 to 14 business days.

5.2 During peak seasons (Limited editions, Holidays, Launches)

Style and exclusivity sometimes require a little more patience. During our collection launches, collaborations, or during year-end periods:

  • The total delivery time can extend up to 30 days.

  • This extension allows us to maintain our high quality standards without compromising on the finishes of your item.

5.3 Delay

In accordance with article L216-2 of the Consumer Code, in the absence of delivery on the date or at the expiry of the deadline indicated when ordering, and at the latest within thirty (30) days, the customer may request the cancellation and full refund of their order.

ARTICLE 6 – RIGHT OF WITHDRAWAL, MADE-TO-ORDER MANUFACTURING AND EXCHANGES

6.1 – Nature of Colibri Riders products and made-to-order manufacturing

Products offered by Colibri Riders are manufactured to order, after validation of the purchase by the customer.

This production method implies that each item is made specifically for the customer, according to the characteristics chosen at the time of order (model, size, color, optional features).

6.2 – Exclusion of the right of withdrawal for personalized products

(Article L221-28 of the Consumer Code)

In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts concerning:

“goods made to the consumer's specifications or clearly personalized”.

As such, any product that has been specifically personalized, including but not limited to:

  • the addition of a first name, last name or any nominative mention,

  • the integration of a specific logo,

  • or any modification made at the express request of the client outside the standard catalog,

is excluded from any right of withdrawal and cannot be refunded or exchanged.

6.3 – Standard catalog products – No refund

Standard catalog items, although they do not involve nominative personalization, are made to order according to a sustainable production model.

As such, Colibri Riders has chosen a commercial policy that excludes refunds, and prioritizes size exchanges when possible, under the conditions defined below.

6.4 – Size exchange for standard catalog products

As a commercial gesture and to offer an adapted experience, Colibri Riders offers a size exchange, subject to availability, for standard catalog items, under the following conditions:

  • the exchange request must be made within fourteen (14) calendar days from the receipt of the order;

  • the item must be returned in its original condition, unworn, unwashed, unaltered, with its labels and original packaging;

  • the exchange is strictly conditional on the availability of the requested size at the time the request is processed.

If the desired size is not available, no refund can be claimed.

Exchange is the only commercial solution offered for standard catalog items made to order.

6.5 – Costs associated with exchanges

Except in case of an error attributable to Colibri Riders or a proven manufacturing defect, return shipping costs remain the responsibility of the customer.

In case of a confirmed error or defect, return and re-shipping costs are covered by Colibri Riders.

ARTICLE 7 – LEGAL GUARANTEES

The customer benefits from the legal guarantee of conformity and the guarantee against hidden defects. In the event of a proven defect, Colibri Riders undertakes to replace the product free of charge or to refund the customer if replacement is impossible.

The legal guarantees of conformity and hidden defects apply independently of the commercial conditions provided for in Article 6.

They cannot in any case be excluded or limited.

ARTICLE 8 – CONSUMER MEDIATION

In the event of a dispute not resolved by our customer service, the customer may free of charge contact the competent consumer mediator CM2C or use the European online dispute resolution platform (ODR): http://ec.europa.eu/odr.

ARTICLE 9 - Collaborations, limited editions and pre-orders

Some products offered on the Site may come from:
- a collaboration with an artist, influencer or other brand,
- a limited edition available for a restricted period or stock,
- or a pre-order.

Pre-orders: Shipping times may vary. An estimate will be provided on the product page or by email. No cancellation will be accepted after validation, except in case of a delay exceeding 30 days.

Collaborative products or limited editions: These items are neither exchangeable nor refundable, except for proven defects. Please carefully check your selection (size, color, visual) before validation.

These specific conditions are clearly indicated on the product sheet and brought to the customer's attention before any order validation.

ARTICLE 10 – APPLICABLE LAW

These GTC are subject to French law.
